The website at aplusbdecor.com (the "Site") is owned and operated by APLUSB DECOR PRIVATE LIMITED ("we", "us" or "our"), a company registered in India.

Acceptance of these Terms

These Terms of Use ("Terms") govern your use of the Site. By accessing or using the Site, you agree to these Terms on behalf of yourself or the entity you represent, and you confirm that you have the authority to do so. You must be at least 18 years old to use the Site. If you do not agree to these Terms, please do not use the Site.

Certain features of the Site may be subject to additional guidelines or rules posted on the Site, which are incorporated into these Terms by reference.

Business use

The Site is for businesses and professionals. Nothing on the Site is an offer. Any supply of goods or services by us is made only under a separate written agreement.

Information only

Content on the Site, including statements about the EU Deforestation Regulation (EUDR), UK fire safety requirements, the Digital Product Passport and the General Product Safety Regulation (GPSR), is general information. It is not legal or professional advice. Please verify the requirements that apply to your products and markets.

Access to the Site

Licence. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your own internal business purposes.

Restrictions. You may not: (i) license, sell, rent, lease, transfer, assign, distribute or commercially exploit the Site or any content on it; (ii) modify, create derivative works from, disassemble, reverse-compile or reverse-engineer any part of the Site; (iii) access the Site in order to build a similar or competing product or service; or (iv) copy, reproduce, distribute, republish, download, display, post or transmit any part of the Site except as expressly permitted by these Terms. All copyright and proprietary notices on the Site must be kept intact on any copies you are permitted to make.

No support obligation. We have no obligation to provide you with support or maintenance for the Site.

Changes to the Site

We may modify, suspend or discontinue the Site (or any part of it) at any time, with or without notice. To the extent the law allows, we are not liable to you or any third party for any such modification, suspension or discontinuation.

Intellectual property

All intellectual property rights in the Site and its content, including copyrights, trademarks and trade secrets, belong to APLUSB DECOR PRIVATE LIMITED or its suppliers. These Terms do not transfer any ownership rights to you, except for the limited access rights above. All rights not expressly granted are reserved. All trademarks, logos and service marks displayed on the Site are owned by us or by third parties, and you may not use them without the prior written consent of the owner.

Third-party links

The Site may include links to third-party websites or services ("Third-Party Services"). We do not control, endorse or take responsibility for any Third-Party Services. You use them at your own risk, and the applicable third party's own terms and privacy practices will apply to that use.

Privacy

Your use of the Site is also governed by our Privacy Policy, which describes the personal information we collect, how we use it and the circumstances under which we may share it. If there is a conflict between these Terms and the Privacy Policy about the collection, use or processing of your personal data, the Privacy Policy will control.

Misuse of the Site

You agree to compensate us for reasonable losses and costs arising from a claim by a third party that results from your misuse of the Site or your breach of these Terms. We will tell you promptly of any such claim we become aware of.

Disclaimers

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we and our suppliers disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure or free of viruses or harmful code.

Limitation of liability

Subject to the paragraph below, and to the maximum extent permitted by law: (a) we and our suppliers will not be liable for any lost profits, lost data, costs of substitute products, or any indirect, consequential, incidental, special or exemplary damages arising from or related to these Terms or your use of (or inability to use) the Site; and (b) our total liability to you for any claim arising under these Terms is capped at the greater of (i) GBP 50 and (ii) the amount you paid us in connection with the Site in the six months before the event giving rise to the claim. Multiple claims do not increase this cap.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited by law. Nothing in these Terms affects any mandatory rights you have under the law of your country.

Termination of access

These Terms remain in effect while you use the Site. We may suspend or end your access at any time and for any reason, including if we believe you have breached these Terms. Provisions of these Terms that by their nature should continue after your access ends will continue.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page or give notice on the Site. Your continued use of the Site after the update means you accept the updated Terms.

Governing law

These Terms, and any dispute arising out of or related to them or the Site, are governed by the laws of India, with the courts at Hazaribagh, Jharkhand having jurisdiction. This does not remove any protection that mandatory law in your country gives you.

Severability and entire agreement

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it valid, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of it.

These Terms, together with the Privacy Policy and any other policies or guidelines referenced in them, are the entire agreement between you and us about your use of the Site. You may not assign these Terms without our prior written consent. We may assign them.
